Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Clubcask (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Clubcask is

Clubcask is a software platform that lets independently operated clubs (“Clubs”) manage limited bottle releases, lotteries, member invitations, and order records for their members. Clubcask is a tool. We are not a party to any transaction between a Club and its members, and we are not a seller, distributor, importer, retailer, or shipper of alcohol or any other product.

2. Eligibility & legal drinking age

You may use the Service only if you are of legal drinking age in your jurisdiction (at least 21 years old in the United States) and legally permitted to purchase and possess alcohol where you live. By using the Service you represent and warrant that you meet these requirements. The Service is not directed to anyone under the legal drinking age.

3. Accounts

• The Service is invite-only; you join a Club through an invitation link it controls.
• You are responsible for the accuracy of your account information and for keeping your password and any two-factor authentication secure.
• You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

4. Orders, payment & fulfillment happen off-platform

A reservation placed through the Service is a request recorded for your Club — it is not a completed purchase. All payment and fulfillment (including shipping or pickup) are arranged directly between you and your Club, off the platform. Clubcask does not process payments, hold funds, set prices, verify age at delivery, or ship or hand over any product. Any dispute about payment, delivery, product condition, or refunds is between you and your Club.

5. Alcohol compliance

You are solely responsible for complying with all laws that apply to your purchase, receipt, possession, and use of alcohol, including age, quantity, and shipping restrictions in your jurisdiction. You agree not to use the Service to facilitate any unlawful transaction.

6. Club operators’ responsibilities

If you operate a Club, you are an independent operator and are solely responsible for your own legal compliance — including any required alcohol licenses or permits, age verification, taxes, recordkeeping, and all applicable federal, state, and local alcohol, shipping, and consumer-protection laws. You are responsible for your interactions with your members and for the accuracy of the content, prices, payment instructions, and fulfillment you provide. You agree to indemnify Clubcask for claims arising from your Club’s operation.

7. Acceptable use

You agree not to misuse the Service, including by attempting to access accounts or data that aren’t yours, probing or disrupting the Service, scraping, or using it for unlawful purposes.

8. Intellectual property

The Service’s software and branding are owned by its operator. Content a Club provides remains the Club’s. You receive a limited, revocable, non-transferable right to use the Service while these Terms are in effect.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Clubcask and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any alcohol transaction, delivery, or consumption arranged through a Club. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us (if any) in the 12 months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold harmless Clubcask and its operator from claims, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Suspension & termination

We may suspend or terminate access at any time, including for violation of these Terms. You may stop using the Service and delete your account at any time from your Account page.

13. Changes

We may update the Service and these Terms. Material changes take effect when posted; your continued use means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-laws rules.
